Buyer agrees to the terms and conditions outlined in this Online Contract (“Contract”) with respect to goods, services, and information provided through the Website or through any sales transactions (phone, email, fax, or in person). This Contract constitutes the entire agreement between CTOMS and the Buyer and supersedes any prior agreements or understandings. The Buyer agrees to review this Contract before purchasing, and any purchase is considered acceptance of these terms.

Retail prices are CTOMS’ standard sale prices. Promotional pricing may be applied at CTOMS’ discretion. Government accounts may qualify for discounts and may require minimum order quantities. Prices may change without notice due to currency or market fluctuations. Quotes are valid only for their stated term. CTOMS may accept or reject any order. Prices are in Canadian dollars unless otherwise stated. Foreign credit card transactions are converted by the card provider.

Orders shipped within Canada are subject to applicable taxes (GST, PST, QST, HST). International orders are subject to all customs fees, import duties, taxes, and brokerage charges, which are the Buyer’s responsibility.

Orders are shipped FOB from Edmonton, Alberta unless otherwise stated. Drop shipping may occur. Title transfers to the Buyer upon delivery to the carrier. Shipping carriers may include Canada Post, UPS, FedEx, or DHL. Shipping costs are based on weight, size, value, and destination. Additional charges may apply and will be confirmed before shipping if significantly higher than estimated. Insurance beyond basic carrier coverage must be requested by the Buyer. CTOMS does not ship to freight forwarding or re-shipper services.

Carrier acceptance constitutes successful delivery. CTOMS is not responsible for lost or damaged shipments or incorrect addresses provided by the Buyer. Returned shipments due to address issues or non-collection may be re-shipped at the Buyer’s expense or refunded minus shipping costs. International orders refused due to customs fees will be refunded minus all return and customs-related costs.

Out-of-stock items depend on vendor availability. Orders may ship in full once all items are available, or partially if arranged with CTOMS (additional shipping charges apply). Discontinued items will be refunded and cancelled.

The Buyer confirms all payment details are accurate and authorizes all charges, including taxes. The Buyer is responsible for all charges incurred through their account and must keep login credentials secure.

CTOMS may modify prices, policies, or website content at any time without notice. Continued use of the website constitutes acceptance of updated terms. Users are encouraged to review terms regularly.

CTOMS reserves the right to refuse service or sales at any time. Product availability is not guaranteed.

The Buyer agrees to indemnify and hold CTOMS harmless from any claims, damages, or legal costs resulting from violation of these terms or misuse of the website.

Website use rights are non-transferable and may be limited by CTOMS or the Buyer’s payment provider.

All products and services are provided “as-is” without warranties. CTOMS limits liability to the amount paid for the product. CTOMS is not responsible for indirect, incidental, or consequential damages.

Products are warrantied only to be merchantable at the time of sale and only for the original purchaser. Remedies may include repair, replacement, or refund at CTOMS’ discretion. Liability for misuse is disclaimed.

Returns or exchanges may be made within 30 days with an RMA. Items must be unused and in original condition. Sale items are final sale. A 10% restocking fee may apply. Shipping costs are non-refundable. Some items (e.g., safety equipment) are non-returnable. Refunds are issued to the original payment method. CTOMS may refuse returns at its discretion.

Warranty applies only to products purchased through CTOMS or authorized dealers with proof of purchase. Non-CTOMS products follow manufacturer warranties where applicable.

The Buyer is responsible for ensuring proper and legal use of products, including required training, licensing, or compliance. CTOMS is not liable for any damages resulting from product use.

This agreement is governed by the laws of Alberta, Canada. Any legal action must be brought within one month of purchase. All disputes are subject to Alberta jurisdiction.

Legal disputes must be handled in Alberta courts. If any part of this agreement is invalid, the remainder remains in effect.

This Contract is the full agreement between CTOMS and the Buyer. By purchasing, the Buyer agrees to all terms. If you do not agree, do not complete a purchase.
